Contractor jailed for forgery and deception

Mongar: 27 July 2007 The Mongar districtcourt sentenced a privatecontractor to 37 months in prisonfor forgery and deceptive practiceson 19 July and he has timetill 1 August to re-appeal theverdict.
The sentence is noncompoundable, which means thathe would have to serve the prisonterm and he cannot pay monetarycompensation instead.
Minjur Dorji, the proprietorof Gayjur Constructions, aC grade construction companybased in Limithang, Mongarhas been found guilty of threecharges. One, forging the taxclearance certificate, two, forginga certificate from the MongarBhutan National Bank (BNB)and also the signature of theBranch Manager and lastly, forusing the forged documents to sitfor construction tenders.
He had reportedly used theforged documents in severaloccasions. He was accused ofdeceptive practices under section296 and 309 of the Penal Code ofBhutan.
Minjur Dorji had forged thetax clearance certificate issuedto another company by the tradeoffice in Thimphu by Xeroxingthe certificate and superimposingthe name of his company in theletter.
The other was a certificatefrom the Mongar BNB. Thecertificate is a necessary documentwhich states that the bankcan extend a financial assistanceof a said amount in case he failsto carry out the constructionwork. He had valued his companyat five million ngultrums.
The case was unearthedafter the Regional Revenue andCustoms Office in Samdrup Jongkhar,where Minjur’s company isregistered, received an anonymouscomplaint in January thisyear. The office informed aboutthe complaint to the Anti CorruptionCommission and the financeministry.
The finance ministryforwarded the complaint to theOffice of the Attorney Generalon 2 April, who pressed the threecharges against Minjur. The casewas registered at the Mongardistrict court on 11 May.
